In a follow-up case to a Federal Circuit decision discussed here, on January 14, 2010 Tyco Healthcare Group LP filed suit alleging patent infringement against Ethicon Endo-Surgery in the District of Connecticut. The suit alleges that Tyco has standing to pursue the claims and seeks to enforce certain Court Orders, including Court’s finding of infringement at summary judgment with respect to two of the asserted patents. The asserted patents are U.S. Patent No. 6,063,050 (“Ultrasonic Dissection and Coagulation System”), 6,468,286 (“Ultrasonic Curved Blade”), and 6,682,544 (“Ultrasonic Curved Blade”). The Complaint further alleges willful infringement and seeks treble damages. Tyco Healthcare is represented by DLA Piper and Jacobs, Grudberg, Belt, Dow & Katz in the litigation.
